Attorney Fees
Attorney Fees in Workers' Compensation Cases
Attorney's fees in workers' compensation cases are fixed by the
Illinois Workers' Compensation Act. In general, fees will not exceed
twenty per cent (20%) of the amount of permanent total disability
compensation recovered on behalf of an injured worker. The Law Offices
of Bradley S. Dworkin will not take a fee on compensation that is
paid for undisputed periods of temporary total disability or for
undisputed medical expenses as paid, on the provision that the employer
or its insurance company voluntarily pays such compensation and/or
expenses in the proper amount and in a timely manner. In cases involving
the death of a worker, an injured worker's total and permanent disability
from further gainful employment, an injured worker's loss of earning
capacity upon his or her return to work in comparison to the injured's
earnings at his or her usual and customary employment, and for certain
specified injuries, the Illinois Workers' Compensation Act imposes
specific limits on the fees an attorney may charge. The Law Offices
of Bradley S. Dworkin complies with these limits.
Workers' compensation claims typically involve certain incidental
out-of-pocket litigation expenses. Such expenses may include the
cost of subpoenaing and/or copying medical and hospital records,
independent medical evaluations, testimony fees for testimony by
physicians and/or other expert witnesses, and court reporting fees.
The Law Offices of Bradley S. Dworkin advances these necessary costs
through the time of recovery, and these costs must be reimbursed
to the office out of the recovery.
