Do I need a lawyer?
Claims for workers' compensation benefits in Illinois are administered
by the Illinois Industrial Commission, a state agency. As in all
other legal proceedings, individuals are permitted to represent
themselves before the Industrial Commission. However, the Illinois
Workers' Compensation Act specifies time limits for reporting an
injury or disease to the employer, and for filing the necessary
documents with the Industrial Commission. Further, anyone involved
in the negotiation of the out-of-court settlement of a workers'
compensation claim or the hearing of a claim before the Industrial
Commission is expected to have in-depth knowledge of the Act and
the Rules of Evidence that are practiced in Illinois courts.
Employers and their insurance companies are represented by competent
attorneys whose jobs are to defeat claims, or to at least minimize
the total amount of compensation an injured worker will receive
from their client. It makes sense for injured workers to retain
legal counsel well-versed in Illinois workers' compensation law
to lead them through the legal process, which can become quite complex
depending on the facts surrounding their claims, in order to receive
every benefit that is allowed them under the Act.
